A patent is an official authorization or license granted by the government, conferring an exclusive right or title for a specified duration, particularly the singular entitlement to prevent others from creating, utilizing, or vending an invention.
1. To commence, Maharshi IP Solutions and the Patent Applicant enter into a Non-Disclosure Agreement (NDA).
2. Subsequent to the NDA, upon receiving invention details from the inventors, we typically, though optionally, initiate a Patentability search. This aids in determining the potential patentability of the device or process.
3. Upon a favorable outcome from the search, we proceed to draft and submit either a Complete or Provisional Patent Application to the Indian Patent Office.
4. Once the application is filed, it undergoes publication after 18 months unless an early publication request is made, in which case, publication occurs within a month of the request.
5. Post-publication, we submit a request for examination.
6. Following the examination request, we receive an initial examination report from the Patent Office. Subsequently, we prepare and submit a response to address any prosecution requirements. Once the examiner is satisfied with our response, they issue the patent certificate.
